A German court has ruled that comparing Israel to the Nazi regime does not constitute a criminal offense. Anadolu Agency reported this, citing the legal website Beck-Online.
In this case, a user had compared the actions of the State of Israel to the methods of the Nazi regime in multiple Instagram posts, using the Nazi swastika symbol and the Nazi party flag to make the comparison.
According to reports released earlier this week, a higher regional court in the southwestern German city of Zweibrücken acquitted the woman of all charges, citing the right to freedom of expression.
The court held that if someone uses such symbols to sharply criticize the actions of the State of Israel while simultaneously clearly distancing themselves from—or condemning—the atrocities of the Nazi era, the criminal offense of using symbols of unconstitutional organizations does not apply.
The accused user had posted an image in her “Stories” comparing Israel’s actions in the Middle East conflict to those of the Nazis. It featured a split image showing the Israeli flag on one side and the Nazi party flag—with a partially visible swastika—on the other.
Another post depicted a wall featuring a Star of David with a Nazi swastika placed in its center; soldiers were shown firing from the wall toward an enclosed area, with blood flowing from beneath the wall. The user also included the hashtags #freepalestine and #gazaunderattack in the posts.
A lower court in the city of Ludwigshafen had previously fined the woman 2,400 euros (approximately 2,768 US dollars) for using symbols of unconstitutional organizations. Following an appeal, the Zweibrücken court overturned that verdict. The court cautioned against interpreting the criminal offense too broadly in the context of freedom of expression.
